Terms of Service

These Terms of Service (“Terms”) govern access to and use of the Gradlok platform at gradlok.app, provided by Gradlok (“Gradlok”, “we”, “us”), the operators of the Service. By creating an account or using the Service, you agree to these Terms on behalf of your institution.
1. The Service
Gradlok provides tools to create, schedule, deliver, proctor, and grade online assessments. We may update, improve, or change features over time.
2. Accounts & eligibility
You are responsible for the accuracy of your account information and for keeping credentials secure. You must have the authority to bind your institution to these Terms, and you are responsible for all activity under your account.
3. Acceptable use
- Use the Service only for lawful, legitimate assessment purposes;
- Do not attempt to disrupt, reverse-engineer, or gain unauthorised access to the Service;
- Do not upload unlawful content or infringe the rights of others.
4. Proctoring & institutional responsibilities
Proctoring flags generated by the Service are indicators for human review, not conclusive proof of misconduct. Your institution is responsible for the fair review of flags, for its own examination and disciplinary policies, and for obtaining any consents required by law — including verifiable parental consent where students are minors.
5. Fees, billing & subscriptions
Paid plans are billed on a monthly basis and are exclusive of applicable taxes (including GST). Fees are described on our pricing page and may change with prior notice. Cancellation and refunds are governed by our Refund & Cancellation Policy.
6. Intellectual property
Gradlok and its software, design, and content are owned by Gradlok. Content your institution uploads (such as questions and student data) remains yours; you grant us a limited licence to process it solely to provide the Service.
7. Disclaimers
The Service is provided “as is” without warranties of any kind to the extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free, or that it will detect every instance of misconduct.
8. Limitation of liability
To the maximum extent permitted by law, Gradlok’s total liability arising out of or relating to the Service is limited to the total fees your institution paid to us for the Service in the three months before the event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.
9. Termination
You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or misuse of the Service. On termination, you may request export or deletion of your data as described in our Privacy Policy.
10. Governing law
These Terms are governed by the laws of India, and the courts of competent jurisdiction in India will have exclusive jurisdiction over any dispute, subject to any applicable arbitration agreement.
